Understanding The Legal Costs of a No Win No Fee Service
Workers Compensation Claim
If your matter is resolved directly with the insurer without the need to make an application, you will still be invoiced for work done, but only at the end of your matter. If your matter requires a WorkCover application, you may need to pay for items like medical reports. While these costs are usually recovered when your workers compensation claim is successful, you will not be refunded for them if your application fails.

Common Law Claim

However, you will still have to bear the costs of other things like the expert reports, witnesses, barrister fees, court fees and all the other disbursements that you or we have already paid during the course of the action.
If you are unsuccessful, it is almost certain that you will also have to pay the other party or parties’ legal fees, which could be significant. This situation often arises if you pursue a common law compensation claim against your employer but fail to prove your claim at trial. In this case, the court will likely require you to cover the defendant’s legal costs.
If you have a valid claim, it is unlikely that you will end up paying the other party’s costs if you follow our advice. Since you can settle the matter at just about any stage of the process, you will have several opportunities to resolve it early, and if you do, the risk of it happening is almost certainly zero.
Disbursements
Disbursements are the expenses that you incur in progressing a legal matter. These are costs we can incur on your behalf to gather the evidence needed for your case or pay fees as part of the process.
